So an update, the comments period was opened up for today.
Also there was a settlement announced yesterday in what many people consider to be one of the worse cases settled.
A white woman accused 2 black athletes of raping her. They were expelled within 24 hours, no hearing. There were people in the house. They backed up the men's story. 2 women were threatened with school discipline for doing that. A female RA said the girl was boasting about it, and showing video. The 2 young men were not only expelled, but named by the college. reason.com/blog/2018/01/18/a-false-accusation-and-an-unfair-investi
Also, the ACLU has readjusted it's stance. While it still has issues with the new rules, (As do many, myself included) it's now in favor of the changes and are far more in line with these than those under Trump where schools hid charges, evidence, avoided hearings, cross examination, and presumed guilt.

There have been a few other settlements after court losses. Boston College seems like it's headed to court for a 1 year suspension already served in a case where forensic, lie detector and video indicate the assault happened, but the wrong student was blamed, but the school gave the real offender immunity and when the panel was prepared to return a result of no finding, the president intervened and they changed to responsible. The family asked them to expunge his record upon graduation and they refused. They don't want to admit they were wrong.

“The ACLU supports many of the increased procedural protections required by the Proposed Rule for Title IX grievance proceedings, including the right to a live hearing and an opportunity for cross-examination in the university setting, the opportunity to stay Title IX proceedings in the face of an imminent or ongoing criminal investigation or trial, the right of access to evidence from the investigation, and the right to written decisions carefully addressing the evidence,” it states.
