So...this happened: Guy was showing off and I guess forgot about his concealed handgun? Gets carried away, does a flip, and then his gun fires when he picks it up, shooting a man in the leg. He then lifts his hands up like "my bad" and walks away, not even bothering to check if anyone got hit. Idiot. Was he drunk? Does it matter? Should he be fired? Should the victim sue? If I were that agent, I would have to move to another country and start my life over (preferably in an isolated vineyard in Italy) due to a chronic and severe case of embarrassment.

Could it be possible the fall knocked the safety off, and then he touched the trigger? Charges would seem extreme, but failure to secure his sidearm is pretty serious.

I think he should be fired, all applicable charges filed, and his victim win a huge settlement against him personally.
This is job, FFS. He's supposed to be a professional gun user. There's even less reason to cut him slack than your ordinary gun owner. When it's your job to do something professionally, you should naturally be held to the highest standard. He's had gobs and gobs of training and range time and gotten paid for his efforts. There is no feasible excuse for his behavior.

Could it be possible the fall knocked the safety off, and then he touched the trigger? Charges would seem extreme, but failure to secure his sidearm is pretty serious. Yeah, that excuse--if he offers it--is right at the top of the "lame" list. Sure, I guess the fall could have knocked the safety off, but what's the chance such is the case, as compared to the chance that an idiot agent who gets drunk, dances, and does backflips with his gun in his waistband forgot to put the safety on? Ten will get you twenty, he carries the gun the way he carries it as a means of picking up chicks--or dudes--as he shows it to them after his "don't tell anyone but I'm an FBI agent" line. |

I have a former colleague who went into the FBI. When he first got the job, a bunch of us kept trying to get him to show us his gun when we were out one night, and he wouldn't. He said he wasn't supposed to be pulling it out and showing it except in the line of duty.
But then, he took his job pretty damn seriously.

Yeah, I have several friends in the FBI down here. That's something they just won't do. But then, I'm pretty sure they also don't tuck their weapon into the back of their waistband, then hit the club scene for some break dancing. I can't imagine how this guy could possibly keep his job. If he does, that says something pretty bad about his superiors.

Oh look: The FBI says it's conducting an investigation, but if the above is correct, what is there to know? The guy was off-duty on a personal trip (i.e. vacation) and walking into a club that---according to the above--has a policy forbidding firearms.

My question is to determine how it happened, if this was accidental or not, and if criminal charges would be appropriate as opposed to a review board. I'd imagine he'd lose his job for this. When I was involved with the police department, we were told that on gun and shield day, (When they give PO's their guns to carry along with their shield towards the end of the academy) a supervisor caught some idiot in the bathroom pulling his gun out and posing in the mirror. He was terminated on the spot. (I imagine he may have appealed) As far as the gun on property that's not allowed, how does that work with off duty officers? They're usually required to carry 24/7 because if they witness a crime, they're on duty. |

Of course it was an accident; he didn't mean to shoot someone. Secondly, as to carrying while off duty, I believe FBI agents--and many other LEOs--are forbidden from carrying if they are drinking.
