Not really sure what his chances are here.
In terms of the Dumpster, the reality is rape isn't like real estate. (Location, location, location.) It's what happened, not where. But if the jury believed it happened behind a dumpster and lets say it didn't, that does paint a pretty compelling picture.
Character witnesses? I thought there were eye witnesses to what happened?
He already served his weak sentence, so the end game here is to avoid having it on his record and not be a registered sex offender. That won't matter in many ways as he's so well known. (Unless he drops out of the public eye and changes his name legally.)
Also, he was given a very light sentence because the judge thought he was remorseful. This appeal would indicate that wasn't true.
I doubt there's a way for him to, if the appeal fails to be sent back to jail for a longer term.
Someone said there's a time limit on appeals? Is that true?
In the motion, which was obtained by BuzzFeed News, Turner's lawyers argue that the jury did not see sufficient evidence to represent their client's character, and was not permitted to consider a lower-level offense.
According to court documents, the lawyers are also arguing that the assault did not occur "behind the dumpster," but rather a "completely open setting," and that the jury received "extensive 'behind-the-dumpster' propaganda." They are requesting a new trial in the hopes of overturning Turner's convictions, which require him to become a permanently registered sex offender.
"What we are saying is that what happened is not a crime," John Tompkins, Turner's legal adviser, told NBC. "It happened, but it was not anywhere close to a crime." He went on to describe the trial as "a detailed and lengthy set of lies."
