I think you're right. United is in trouble, legally and from a pr persepctive (obviously). But look, it's a legal argument, it's no a obvious thing in the moment. So again, I would argue that fighting to stay on a plane is still pointless, is just ratcheting things up. You're not going to win. And I still think the captain of a plane has the authority in the moment to order anyone off of the plane. That doesn't protect the captain from future litigation or even criminal charges. But again, there's nothing one can do about it if one is ordered off.

Oh and fyi, the real shame here is that all United probably had to do was up their offer to people until someone was willing to deplane. That would have cost them far less than all of this will cost them. Plus, it would never have been a story, at all.
Pretty stupid. There's a good number of people whose heads may be on the chopping block, I guess.

I think the guy figured (as I would have) that United would not escalate it to this point but instead would do what it should have done: keep offering higher compensation until someone took it, or have the employees take another way. The situation escalated minute by minute, and by the time they physically hauled him out of his seat, it was too late.
Frankly, I can tell you that if I had a truly pressing reason to get where I was going, I would have been this guy. I am not particularly compliant when I believe myself 150% in the right. It would have to be a matter of some importance (not a bit of minor rescheduling), but I'd fight.

Another thousand bucks would almost certainly have netted them a willing volunteer (not this guy), and saved them from a truly atrocious PR (and if I'm right, legal) mess.

Well, I would guess that after United told the passengers that they would have to randomly select someone to be bumped, he was told that it was him and that he had to deplane. I would guess that the captain either personally or over the intercom told him he would have to deplane. And when he refused, I would guess that they told him airport security was coming to escort him off of the plane. At that point in time, fighting to stay on the plane is pointless. You're not going to win. Security is not going to say "gee, he really wants to stay, let's let him." And again, the captain still has the final say so in the moment. Why fight? So you can potentially get hurt? It's pointless and stupid, even if you know that you have a case--legally--against the airline.

Also, I think dragging up things from this guy's past is gross and has nothing at all to do with this situation. I don't give a damn what he did years ago, or even what he does right now - the airline was still in the freaking wrong here.

The doctor who got beat and the doctor with the criminal record share the same first and last name, but not their middle names. It appears they've confused two different people.

Yeah, I just heard that, too. Plus, United has apparently admitted that THEY WERE NOT OVERBOOKED. AND, the employees for which they bumped passengers presented themselves at the gate AFTER the plane was already fully boarded.
